Indiana Central News TERRE HAUTE - Terry "TJ" Smith was found guilty at a jury trial in Sept. 2014, for his role in using excessive force when arresting two individuals in Greencastle. Today, United States Attorney Josh Minkler announced the re -sentencing of the former Putnam County deputy to include serving additional time in prison. Smith was found guilty of two counts of deprivation of civil rights while exceeding his authority as an officer at the time.The case was reassigned to Judge Jane Magnus-Stinson who sentenced Smith to 19 additional months today in Terre Haute. According to the Unites States Attorneys Office - Southern District of Indiana press release, officials wanted to send a clear message while enforcing the law fairly in the prosecuting and re-sentencing to 33 months from the previous sentence of 14 months imprisonment three years ago. The U.S. Attorney’s Office for the Southern District of Indiana reportedly appealed the sentence to the Seventh Circuit Court of Appeal in Chicago arguing that the sentence was unreasonably low. After the appeal to the Seventh Circuit the case was remanded to the District Court for re-sentencing. -- The case was prosecuted by Drug and Violent Crime Chief Bradley A.
